Case 8.1 The Coca-Cola Co. V. The Koke Co. of America.Review the case summary beginning on page 140  of your text and type responses into a MICROSOFT WORD DOCUMENT. Remember to individually number each response. Upload the document into Blackboard. Please do not upload documents in any other format as Blackboard will not recognize them. NOTE: The case summary included in the textbook is heavily condensed. Students should understand that "Coke" was approved for trademark protection as a "suggestive term" because it referred to one of it's principle ingredients. Coca-Cola is suing the Koke Company for trademark infringement due to the similarity of the two names (Koke v. Coke). The Koke is arguing that Coca-Cola's use of Coke should not be protected under trademark law because the beverage no longer contains the ingredient (cocaine) which formed the basis for recognizing the trademark in the first place. Under current law, what must be proven to successfully bring a general claim of trademark infringement? Explain how the Koke company has infringed upon Coca-Cola's trademark (i.e., apply the facts to the law identified in your response to question 1, above)   How does a claim for trademark dilution differ from a claim for trademark infringement?

Prepare for Writing Assignment/Group Discussion #2: Hot Coffee and Negligence (ASSIGNED MATERIAL) Prepare for Writing Assignment/Group Discussion #2: Hot Coffee and Negligence (ASSIGNED MATERIAL) The purpose of this assignment is to apply legal principals from Modules 4 and 5 to a real case. Assigned Material for Writing Assignment/Group Discussion #2 and covered on Test #2 (you may rely on and cite ONLY these two resources in your Post or Replies; you may not cite Internet sources or lecture slides): Read Chapters 2 and 5 of the textbook. (You must have at least one citation to Chapter 2 or 5 in your Post.) Watch the "Hot Coffee" documentary (link opens in a new window - watch first 15 minutes only) (You must cite in your Post.) Warning: There are graphic images from minutes 6:25-6:31, 6:48-7:00, and 7:45-7:50. You might need to log in with GMU credentials first. Watch the first vignette related to tort law and Liebeck v. McDonald's (the first 15 minutes) and take notes. Writing Assignment/Group Discussion #2: Hot Coffee and Negligence (click here and then "Hot Coffee" discussion board to start thread) Read these instructions at least three times through before posting. Also read my weekly announcements for specific assignment hints, guidance, and possible extra credit. Remember you will fail this assignment and face a possible referral to the Office of Academic Integrity if you QUOTE, CUT/PASTE FROM ANY SOURCE INCLUDING THE ASSIGNED MATERIAL or use/rely on any resources, including classmates, the lecture slides or Internet sources, other than the two resources (textbook, Hot Coffee documentary (first 15 minutes) in the Assigned Material (see the box above labeled "Prepare for Writing Assignment/Discussion #2). In addressing the prompt below (in red and italicized), you must cite to Assigned Material in your Post and Replies (see below). You may use the lectures and lectures slides for your own learning and background, but you may not cite to the lectures or lecture slides in your Post or Replies (you will be able to find a similar reference in the textbook). If you choose to complete this writing assignment, watch “Hot Coffee” (first vignette, approximately 15 minutes) and read/listen/review material related to chapters 2 and 5 (Asssigned Material). Each student will be assigned to a group of students. After watching/reading the Assigned Material prepare your writing assignment (post) in a Word document. You may use the spell-check and grammar check features. Access your discussion board by clicking on the link above and create a new thread. Once you create a new thread cut and paste your writing assignment from your Word document into your thread by 11:59 PM on Friday. After copying your Writing Assignment to the thread, you MUST then upload your Writing Assignment (post) to SafeAssign within 5 minutes to avoid a 0 score. The SafeAssign link can be found below the Writing Assignment/Group Discussion in Blackboard. Unfortunately, Blackboard does not allow for SafeAssign submission in the discussion board. If you do not upload your Writing Assignment (post) to SafeAssign, you will earn a 0 score on that assignment. Click above "Writing Assignment/Group Discussion #2" to access the discussion board. Your initial post is worth 45 points and your replies (two are required) are worth 15 points, 60 points total for the writing assignment. Please read the additional instructions in the syllabus. You will not be able to see other posts until you post. Please treat this assignment as a serious writing assignment. The rubric is strictly followed and no one gets credit just for posting, therefore prepare your post ahead of time and copy into your thread. Once you post, you will be able to see other posts and you can then reply. However, if you post in error before your post is complete or your post is blank, the first post will be graded even if blank. You are required to reply to at least two of your classmates by 11:59 PM on Sunday. Your replies must be substantive and MUST include citations in parenthesis according to the instructions above. For example, your replies should extend the discussion or provide another legal perspective, but your replies should not be critical of your classmate’s work. Your replies are worth 15 points and you must provide more than one substantive reply to be eligible for 15 points. IMPORTANT GUIDELINES: Your Post/Replies can only be based on the Assigned Material (“Hot Coffee” video (first vignette) and chapters 2 and 5 of textbook), and other responses (for your replies). Internet resources and other resources outside the course material are prohibited, as is collaboration. ******Your Post should be approximately 300 words and each Reply should be approximately 150-200 words. ********* Showing substantive knowledge of the Assigned Material requires addressing the prompt and providing at least FIVE accurate examples or support from the Assigned Material (with citations) supporting your analysis and in your own words (DO NOT QUOTE, OR CUT/PASTE, show your own understanding in your own words in your Post and Replies). You must cite to ALL Assigned Material in your Post, which must include at least one citation to the textbook (chapter 2 and/or 5) and at least four other citations to the Hot Coffee video (at least five citations in your Post), which support your analysis. In other words, you should have at least one citation to each of the items listed in the Assigned Material section on Blackboard and no less than five citations total. Each reply must have at least one citation to the Assigned Material. Cite to your sources in parenthesis in the following way: provide the minute from the video (i.e., Hot Coffee 5:10) and provide the section/page of the textbook/e-book (i.e., Chapter 4, page 95 or Chapter 4-2b). Also, remember you are not being asked for your opinion, you are being asked to apply/analyze the law. A citation list is not required because everyone has access to and is using the same required resources in the Assigned Material list. DUE DATES ARE STRICTLY ENFORCED. THESE ARE SERIOUS WRITING ASSIGNMENTS AND THERE IS NO CREDIT FOR POSTING OR REPLYING LATE. The OSU Academic Integrity policy applies to this assignment. This policy states the following. Academic Integrity Oklahoma State University is committed to the maintenance of the highest standards of integrity and ethical conduct of its members. This level of ethical behavior and integrity will be maintained in this course. Participating in a behavior that violates academic integrity (e.g., unauthorized collaboration, plagiarism, multiple submissions, cheating on examinations, fabricating information, helping another person cheat, unauthorized advance access to examinations, altering or destroying the work of others, and fraudulently altering academic records) will result in your being sanctioned. Violations may subject you to disciplinary action including the following: receiving a failing grade on an assignment, examination or course, receiving a notation of a violation of academic integrity on your transcript (F!), and being suspended from the University. You have the right to appeal the charge. Contact the Office of Academic Affairs, 101 Whitehurst, 405-744-5627. You may find further information online. Facts Situation Lightning Parcel Service ("Lightning") is based in the Oklahoma City regional area. Lightning focuses its efforts on delivering products to home consumers and small businesses. Lightning has a need to hire drivers for its delivery trucks. In an effort to reduce costs, Lightning recently adopted an independent contractor model. Under this model, rather than hiring drivers as employees, Lightning will contract with drivers as independent contractors. The independent contractors will be in business for themselves. Lightning has developed a lengthy contract that it asks drivers to sign. The contract contains the following clauses. The contract contains the express sentence: "Driver acknowledges that he or she is an independent contractor and not an employee." Lightning requires that the drivers go through the standard Lightning training program before being allowed to deliver packages. The drivers are not, however, paid for their time while going through the training program. The drivers must use Lightning uniforms but must purchase the uniforms themselves. Lightning permits the drivers to purchase their own delivery trucks. If a driver chooses not to furnish his own vehicle, Lightning will rent the driver a truck at a fixed weekly rate. In any event, Lightning requires that the trucks be painted using Lightning colors and logos. Lightning provides the routes that the drivers should drive each day. Lightning does not oversee the drivers to determine whether they drove the suggested route. Lightning drivers are free to hire someone else to drive their routes as long as the substitute driver maintains the same route. Drivers must check in with Lightning periodically throughout the day to see if Lightning has any additional deliveries to make. Lightning allows the drivers to use the trucks on their days off for personal deliveries, as long as the driver covers up the Lightning logo. Lightning drivers may sell their routes to other drivers. Complication Lightning hires a new general counsel (the top legal officer), Roseanne Park. Shortly after beginning work, Park becomes aware of the independent contractor model. Because the Department of Labor announced a misclassification initiative, Park is concerned about potential violations of the federal wage and hour laws. She is not sure about worker classification issues, but has heard that you did very well in your employment class. Question You should answer this overall question: Under the facts as given, are the Lightning drivers employees or independent contractors? Using the economic realities test, determine whether or not the workers are employees or independent contractors. Your answer will require you to explain why the economic realities test is proper under the circumstances. In your answer, list the elements of the test, analyze the facts in light of the elements, and draw a conclusion. You should evaluate both sides of the question, explaining both arguments and counter-arguments.

Part 1; Report needs to be 8-10 pages, double spaced, 12-point font, APA format. NEED COMPLETED BY 8/6/24 EARLY AFTERNOON IF POSSIBLE Your task is to research the legal and ethical issues associated with this situation and write a report to the vice president answering the following questions: What legal theories might Mark use to try to legally enforce Edward's promise? Explain the elements of these theories and how they apply to the facts of this scenario. If Mark were to file a lawsuit and win, what sort of damages or other remedies might he be entitled to? Include your reasoning and any evidence that led you to your conclusions. Finally, regardless of the legal implications, the vice president would like your view on the ethical issues. Does Turnip Plaza have an ethical obligation to fulfill the promise made by Edward to Mark? Is it right to lay off Mark under these circumstances? What should Turnip Plaza do from an ethical perspective? Use ethical theory and principles to analyze these questions -- -LEARNING TOPICS ----- First, find the necessary information about contract formation and execution. Then, look into possible contract remedies for when a breach of contract occurs. After you have refreshed your understanding of contract law generally, you should supplement that understanding by doing legal research on specific laws related to contracts in Michigan. Again, make sure to take notes as you read. Good notes will help you write your report. Thinking over this case, put some of your focus on Edward Griffin's role in this situation with Mark Piper. More specifically, consider whether Edward had the authority to make the promise he made (or any promises) to Mark. Review the legal responsibilities of agents and employees to help formulate your answer. You should also review ethical business decision making, as it pertains to keeping promises in business situations and the ethical questions I have asked you to consider. -------I HAVE ATTACHED THE SCENARIO AND LEARNING TOPICS----- PART 2: The discussion post for the International Legal Challenges needs to be completed by 8/10/24. You begin by researching international law, international contracts, an introduction to alternative dispute resolution, and international dispute resolution. DISCUSSION WITH COLLEAGUES Now that you’ve gathered and analyzed information on the International Legal Challenges case file, Vice President Dodger would like you to discuss your thoughts with the other members of his special investigations team. He sends you two requirements for this discussion: First, each participant is to post an initial response to at least two of the five questions noted in the International Legal Challenges file. This should be completed during Week 5 and should meet the following requirements: Include a specific recommendation of what action, if any, the VP should take based on your analysis and conclusions. Support your conclusion with references to legal principles and laws. These posts can be as long or as short as you need in order to effectively make your points. -------I HAVE ATTACHED THE SCENARIO AND LEARNING TOPICS-----
