please respond to Amanda When it comes to the Rule of Lenity, I'm not whole heartedly in favor for it. I think it would depend on the type of crime that was committed and if the person being accused of the crime has had previous arrests for the same incident. I think for me it's the wording that says it should be interpreted in favor of the defendant. If it is a first time defendant, then ok, if they are remorseful and the court believes this person won't commit this crime again, then I am all for it. Although if this defendant has multiple similar charges and has no remorse for the crime they committed, then no, they should get the full punishment as stated in the law.   I do believe that justice for any victims under the Rule of Lenity could be greatly impacted. First time offender of assault with injury, but it leaves the victim on life support for the rest of their life. What happens when this defendant only gets probation and some public service hours. Or even if they are just to get a slap on the wrist and told not to do it again. How would you feel if that was your family member left in that hospital bed Is that fair for the victim and their family? Absolutely not. When it comes to justice for victims and their families, the law should be upheld to the highest offense. If they are given a lesser punishment under the Rule of Lenity, they will be back out in society doing the same thing to someone else's family member, and the cycle will continue.
