Description research the employment laws for the state that you reside in. These can usually be found on your state’s Department of Labor website (visit the U.S. Department of Labor State Labor OfficesLinks to an external site. webpage if needed for a list of these). Federal law provides the primary source of regulations that apply to employee rights, wages, benefits, and working conditions. Another major source of employment law comes from state law. While states must follow federal law, each state has its own set of laws relating to fair employment and workplace safety. However, these protections can vary greatly from state to state, as some are more “worker-friendly" than others. Some states may also offer worker protections through a Human Rights Office. Then address the following questions: Briefly describe additional employment laws or rights that your state has in addition to federal law. Discuss whether you believe the employment laws in your state provide more benefit to workers or businesses. Explain why. To support your answer, you may need to compare the employment rights in your state to a state which has different laws. In your opinion, are state employment laws necessary to provide fair working conditions (wages, benefits, safe environment, etc.) for employees? Or do these regulations create an undue burden on employers? Explain your answer.

Description Part I Select two of the scenarios listed below and explain the best solution for each. Include comments related to any ethical issues that arise. Scenario 1 - Crimes Select 3 crimes from your state that you find unusual or interesting. Educate the class about the crimes by providing the statute number and name and a summary of the law in your own words. Pick one of the statutes and find one case decided in your state related to the statute. Scenario 2 - Torts and Crimes Michael, a former employee of AutoNation Ford, entered the repair shop, claiming that the company owed him $560 in back wages. Michael argued with the general manager, Bill. After several minutes, Bill ordered Michael off the property. Michael refused to leave, so Bill told two mechanics escort him off the property. Michael ran to his truck, but on the way, he grabbed some electronic parts valued over $500 and drove away. Michael refused to return the parts until he was paid. Discuss whether Michael has committed any torts or crimes If the mechanics had forcibly kicked Michael off the property, would the two mechanics or AutoNation Ford be guilty of assault and battery? Explain. Scenario 3— Intellectual Property Professor Cody teaches business law for Fowler University, a for-profit school in Boston. Several times during the semester, Professor Cody made copies of articles and distributed them to her students. The son of one of the article's authors was a student in her class. The son told his father about the professor's copying, which took place without the father's or publisher's permission. Professor Cody also copied images from the Internet to use in her Powerpoint presentations. Most of the images were not in the public domain and no attributions to sources were provided. Discuss the potential violations related to intellectual property rights. PART II Select two of the scenarios listed below and explain the best solution for each. Include comments related to any ethical issues that arise. Scenario 1 - Offers Kelly’s collie puppy ran off, so she posts flyers in the neighborhood advertising a reward of $100 for finding and returning the dog. David finds a collie puppy on his front porch. He looks at the dog tags, calls the number, and Kelly rushes over to pick up her puppy. Later, David sees the reward poster. Can David claim the reward? Provide arguments for each party. Support the answer with a relevant journal article or case. Scenario 2 - Consideration Jackson was hired to sell consulting services for Acme Accounting and was promoted to manager four months later. A short time after the promotion, Jackson was required to sign a non-compete agreement. When the business suffered financially, Jackson joined with a former employee to create an accounting firm that also solicited clients for consulting business. Acme sued Jackson to enforce the agreement. What was the consideration for signing the non-compete agreement? If you find consideration, was it adequate? Would your answer change if Jackson had to sign the non-compete at the time of his promotion? Scenario 3 Capacity and Legality Hank was a talented soccer player and started playing competitively in 2014 when he was sixteen. Many of the tournaments required participants to sign an exculpatory clause in order to participate. One of Hank’s parents signed the agreements. In 2016, Hank participated in the regional soccer championships in Atlanta Georgia. During the event, several players crashed into each other and Hank sustained an injury to his back, leaving him partially paralyzed. Hank filed a negligence lawsuit against the tournament organizers. The organizers could not find the exculpatory clause that Hank signed for the event. The organizers argued that Hank must have signed the agreement to enter the tournament, but even if he had not signed one, his participation in the event demonstrated his intent to be bound by the terms of the agreement. Did Hank have contractual capacity to enter the contract? Why or why not? If Hank did not actually sign the exculpatory clause, could a court conclude that he impliedly accepted its terms by participating in the tournament? Why or why not? How would you rule in both of these situations? Support your answer with scholarly material and case law.

Description I need assistance with my discussion assignment and reponses that are needed. The assignment states: During COVID, many people became frustrated when contracts could not be fulfilled. In actuality, there have been many times when contracts could not be fulfilled due to impossibility. Read the Parker v. Arthur Murray, Inc., 295 N.E.2d 487 (Ill. Ct. App. 1973) case using the textbook link in Week's 5 Reading/Video View Assignments, pages 522-524. In this case, even though the contract had statements that this was non-refundable, the Court held differently. Research another case dealing with the doctrine of impossibility to perform and answer the following questions: Identify, compare, and contrast the facts of both cases. If you were a business owner, do you think non-refundable clauses in contracts are ethical, why or why? Would your position change if you were a consumer who had signed a contract with such a clause? Description Class, I will offer Tips and Hints on each of our weekly DB’s (we typically have one DB with two parts per week). I will focus on providing guidance on our DB’s.  My Tips and Hints are entirely optional, and you can choose to follow my advice or not – the quality of your response(s) is up to you and you are responsible for all of your research, interpretation, and APA formatting (citation and referencing).  These Tips and Hints are offered as a courtesy. Thanks, Dr. Vic. Dr. Vic: Please make sure you fully discuss our DBs do not just post two or three or even four sentences, please make sure you have reached a solid graduate level discussion. Also, post at least one (1) peer-to-peer comment for each DB as well by Sunday of each week – posting more peer comments is preferred for graduate courses, please keep in mind, at least one comment is required. Statement of Work (SOW) a)Examine the components of a SOW for the purpose of open competition without restrictive provisions. Select a field that you are interested in and determine the information that would be included in a SOW for a contract in that field.  (Dr. Vic’s Tips: this question follows information from Ch. 5 of our Compton textbook very closely. You will want to read the entirety of Ch. 5 and pay particular attention to p.p. 45-47, the section entitled “Format of a SOW and Common Elements”. Then after you have discussed these common elements, address the second portion of the question and discuss the field you are interested in and the contents of SOW for that field. Market Research a)From the e-Activity, evaluate the listed resources for market research, and then explain which source you found to be the most accurate and why. Determine how this Website will help you while conducting market research. (Dr. Vic’s Tips: you will want to make sure you use information from both our Feldman (Ch. 10 – a very short chapter) and our Compton (Ch. 4) textbooks for this DB question. As far as the e-Activity, the link should work, but if not, please focus on simply describing the definition, form, function and purpose of Market Research, please use info from FAR and the following sites: SBA document (it’s about 30 pages in pdf) site: https://www.sba.gov/sites/default/files/files/mkt_workbook.pdf Or Click here for the document: Week_2_B1_SBA_Mkt_Research.pdf  GSA website on Market Research (look at Sec. 3, p.22): https://interact.gsa.gov/sites/default/files/mas_desk_reference_-_2010.pdf Or Click here for the document: Week_2_B2_GSA_Mkt_Research.pdf  GAO Website – Document on Market Research: http://www.gao.gov/assets/670/666447.pdf Or Click here for the document: Week_2_B3_GAO_Mkt_Research.pdf  e-Activity Link: https://www.hhs.gov/grants/contracts/get-ready-to-do-business/index.html%20 Respond to the following post: "Statement of Work (SOW)" Please respond to the following: Examine the components of a SOW for the purpose of open competition without restrictive provisions. Select a field that you are interested in and determine the information that would be included in a SOW for a contract in that field. The statement of work should include what the objectives of the project are, the scope of the project, the schedule, the price of the materials or service, key assumptions, and acceptance (Barry, 2010).     This is a document written by the federal government that outlines exactly what it is a vendor is required to do. The SOW (Statement of Work) is used to evaluate quotes that are submitted by different vendors. Each vendor is evaluated fairly and the award/contract should always be given to the bidder who meets all qualifications which includes a fair and reasonable price. Besides my regular job I also attend and have planned a few conferences where we deal directly with the hotel to set up events for the day or the weekend. Within the statement of work things such as the requirements for the wait staff, room size, table and chair setup along with technology equipment. How to proceed with the events for the day, how much coffee and water to serve, what time to put out the food. Under documentation would be the breakdown of pricing for each thing. The background section of the SOW would include the reasons behind the conference which fully detail what we do and all requirements we have and what we expect from the venue. From the e-Activity, evaluate the  listed resources for market research, and then explain which source you found to be the most accurate and why. Determine how this Website will help you while conducting market research. I believe each of the resources have value but the one thing most businesses have a hard time with is actually finding the business. By having access to the link to find contract opportunities a small or large business has access to many different contract opportunities. Links such as FedBizOpps.com gives new vendors a place to go to view not only opportunities from HHS but other agencies as well. It shows each agency and how many notices they have out there. This website along with the other resources under find contract opportunities not only gives knowledge but puts a vendor in the position to be able to search and find contracting opportunities
