Leaders must understand the importance of the brand to business success and sustainability. It is important for you to reflect on the last nine weeks and the relevance of marketing to optimizing a brand. The theme park scenario you have worked on will, someday, not be a purely hypothetical situation to you. You will be faced with real-world crises and challenges. There will be critical roles for marketing and other functional departments to play when they arise. One of the important factors in your personal success will be how you brand yourself. What do you represent? Why should you be the "go-to" future leader of an organization? Why should you be the first choice as that leader? You are being asked to self-reflect on what you want your personal brand to be. In your initial post, you should address the following questions based on what you learned in this course: What are at least three key course takeaways that resonate with you and that you may use in your current or future workplace? Explain how they resonate with you. When thinking of attributes of an effective leader, what personal brand traits do they appear to possess? Describe your desired personal brand. How can being a lifelong learner help with reaching your desired personal brand image? When responding to at least two of your peers' posts, consider the following: Compare and contrast your learning from the course with that of your peers. How do your views on the attributes of an effective leader align with those of your peers?

Assignment #3 - Final Project  Final Project  The final project is a case study using a formal case study method as the framework for the case analysis. It is in lieu of a final exam and will assess your abilities to identify, analyze, synthesize, and recommend marketing strategies based on a unique global marketing situation.  This is the Case: Case: Chipotle in China Cite as: DeMicco, F., Parsa, H., Gao, J. & Narapareddy, V., (2018). Chipotle Mexican grill: A sustainability champion going global with China. In SAGE Business Cases. 2020. 10.4135/9781529717617 The due date is the last day of this class and is listed in the Course Calendar and in the Assignment. No work will be accepted after the last day of the class. Approach this Final Project Case Study as follows: Read the case for the first time early in the semester. Check out the student aid "How to Prepare a Case Study" in the Marketing Toolbox.  Download the worksheets to help you with your analysis. Post any questions you may have in Ask the Professor.  Read the case over a second time, minimally, prior to beginning your writing. Conduct external research on the issues for relevance to support your opinions. Seek out counterarguments to ensure your opinions are well grounded or to modify your opinions. Do not focus on the history of the company. Focus on the global marketing challenge and how to solve it. Produce the Final Project case study as follows: Create it in MS PowerPoint software. Save it as a .PPT or .PPTX extension. Adhere to the APA academic style. This is used in business. Employ the use of external sources and case authors to defend arguments or provide counterarguments. Generate at least the minimum number of slides as suggested below, but feel free to use as many slides as you feel appropriate to communicate your case study content. Demonstrate professionally prepared slide presentation work, free of typos and grammatical errors. (See Microsoft PowerPoint Tips in the Marketing Toolbox, or other source for effectively communicating in the MS Power Point format). Post it in your Assignments folder no later than 11:59 p.m. of the due date.  Presentations will be graded in order of receipt. Suggested Microsoft PowerPoint Presentation Outline Prepare your slide deck following this suggested outlined.  Use as many slides as you may need to effectively but efficiently cover the topic.   Cover Slide:    Name, section number, etc. Title slide: Section 1— The Problem Topic 1.a:  Statement of the marketing challenge Topic 1.b:  Evidence in support of your statement of the marketing challenge Title slide: Section 2—Analysis of the current situation Topic 2.a: Macro-environmental factors affecting the case Topic 2.b: Economic considerations Topic 2.c: Political, regulatory considerations Topic 2.d: Cultural/social considerations Topic 2.e: Product review Topic 2.f: Price review Topic 2.g: Distribution review Topic 2.h: Marketing communications review Topic 2.i: Competitive analysis (focus on direct competitors) Topic 2.j: Product/market analysis (country markets and/or consumer markets) Topic 2.k: SWOT analysis Topic 2.l: Conclusions regarding the current situation Title slide: Section 3—Alternative strategic marketing solutions Topic 3.a: Alternative 1 with pros and cons Topic 3.b: Alternative 2 with pros and cons Topic 3.c: Alternative 3 with pros and cons Title slide: Section 4—Recommendation Topic 4.a: Recommended marketing strategy from one of three alternatives Topic 4.b: Product suggestions Topic 4.c: Pricing suggestions Topic 4.d: Distribution suggestions Topic 4.e: Marketing communication suggestions Topic 4.f: Any additional comments, if appropriate Topic 4.g: Ongoing issues to monitor in the implementation References Exhibits Additional details for each section are as follows: Section 1—Statement of the marketing challenge Read the case carefully, several times if needed, to determine the primary global marketing challenge. Once identified, provide evidence from the case as to why you believe this is the most important challenge facing marketing management of this company. Even though the case may discuss financial, operational, or other issues, be sure this statement is framed as a global marketing challenge. The other concerns will be important in your analysis, but not as the statement of the challenge. Do not summarize the case; only point out those case facts that support your opinion. Be sure your choice is strategic, not tactical. Section 2—Analysis of the current situation Think of this as a snapshot of the situation, or what is true at this point in time. Follow the outline above, which should conclude with a SWOT analysis and relevant conclusions. This sets the stage for your recommended strategies. Verify your findings as much as possible within the case or through your research. But, do not get bogged down if research cannot answer every question. Make educated guesses and note when they are approximations and when they are facts. Section 3—Identification of at least three strategic alternative solutions Based on your analysis, identify at least three possible marketing strategies that you would recommend for this unique global marketing situation. Each of your three alternative marketing strategies should include a discussion of the advantages and disadvantages of each alternative marketing strategy. They should be strategic alternatives and include possible product/markets, mode of entry, country markets, pricing and distribution strategies, and a product/marketing communication strategy. Do not discuss marketing tactics; rather, conclude each alternative with an assessment of how that strategic alternative might solve the marketing challenge. Section 4—Recommendation of a specific marketing strategy From your list of strategic alternatives, select the one alternative you believe is best suited to the situation. Be sure to state your rationale for your choice and some approaches to implementing the marketing mix.

Question(s): When responding to your peers' posts, reflect on how patent infrin ...

Question(s): When responding to your peers' posts, reflect on how patent infringement affects cyberspace and e-commerce. One area of focus could be the gray areas created by recent court rulings. PEER POST # 1 Internet patents, otherwise known as business method patents, are a tool for protecting business practices online. According to Justia, a business method patent "is a type of utility patent that protects a process rather than a physical object. It has proved especially useful to online companies that use software for their business" (Justia, 2023). Business method patents can grant exclusive rights to their owners, creating opportunities to leverage competitive advantage gained by exclusivity, or the owner may choose to license the patent to other companies, charging them a fee to employ the patent in competing products. J.D. Houvener, Patent Attorney and Founder of the website, Bold Patents, discusses Tinder in a 2021 blog post, saying that "One example of an internet patent comes from the well-known online dating app Tinder, which connects individuals via a “mutual interest” swiping method that it claimed was unique and qualified for protection. The company applied for and received a patent for its matchmaking process in 2013" (Houvener, 2021). With a patent, a company can take legal action against others who use the patented method without authorization. This helps prevent infringement and ensures that the company can maintain control over its business practice. Andrew Liptak of The Verge provides an example of this in a 2018 news article that discusses a litigation between Match Group, Tinder's parent company, and Bumble, a competing dating app. "On Friday, Match filed a lawsuit that accuses Bumble of infringing on a pair of patents held by Tinder: one called “Matching Process System and Method,” in which users swipe cards and mutually select one another, as well as “Display Screen or Portion Thereof With a Graphical User Interface of a Mobile Device,” which it describes as an “ornamental aspect” of Tinder’s App. The lawsuit also points to similarities between each companies’ apps, and Bumble’s descriptions of “swiping” run afoul of Tinder’s registered trademarks" (Liptak, 2018). Patents also encourage innovation. My last example is not an internet patent, but it's an interesting example of how "the answer to a design problem” (Caruso, 2017) led to 30 years of innovation in the gaming industry. The D-pad, or directional pad was introduced on Nintendo Handhelds in 1982. They did this to allow for axis movement in four directions as opposed to two, and because a joystick was too cumbersome for the portable device. The design was patented in 1985 and used on every version of the Nintendo console until 2016's Nintendo switch. In an analysis paper I wrote for IT-515, Innovation in Info Technology, I confirmed that "the Nintendo patent expired in 2005, and now we can see the D-Pad as a standard on not only gaming controllers, but other devices like TV and DVD remotes" (Spicer, 2023). Now, while Sony, Sega, and eventually Microsoft had their own consoles, they had to innovate their own versions of the D-Pad, changing not only the operation, but the design of the hardware to avoid infringement. Sega's solution was an 8 direction, disc shaped pad. Sony had their D-Pad enclosed in part of the controller housing on the PlayStation 1, not fully exposed like the Nintendo. Even Microsoft, when it entered the console market, did so with a multi directional pad. Today though, it's hard to find a controller or a remote that doesn't use some variant of the D-pad, and it's pretty neat that we have Nintendo to thank for that. PEER POST # 2 According to Wex Definitions Team (2024) of Cornell University, a patent “grants the patent holder the exclusive right to exclude others from making, using, importing, and selling the patented innovation for a limited period”. Interestingly, patents are guaranteed under the United States Constitution itself and further detailed in the Patent Act of 1790 (Brown, 2016). This established a ‘first to invent’ doctrine for the process of getting a patent. The requirements for something to be patented are “(1) patentable subject matter, (2) utility, (3) novelty, (4) nonobviousness, and (5) enablement” (Wex Definitions Team, 2024). “The first U.S. patent was granted to Samuel Hopkins for a process of making potash, an ingredient used in fertilizer on July 31 [and] President George Washington signed the first patent” (Milestones in U.S. Patenting, 2024). Two major shifts in patents have occurred relatively recently. First, in 1998 an important case, State Street Bank & Trust Co. v. Signature Financial Group, was decided by the Court of Appeals and “the court did away with the “business methods exception” to patentability and upheld a patent on a software program that was used to make mutual-fund asset allocation calculations” (E-Commerce Times, 2003). This ruling made it possible for Amazon to patent its 1-Click technology. Secondly, in 2011 the America Invents Act became law and “switched from a “first to invent” system to a “first inventor to file” system, thereby eliminating interference proceedings entirely. Under U.S patent law, it no longer matters much who invents a thing first, what matters is which inventor files a patent application first” (Brown, 2016). This background information helps make the transition to understanding internet patents and their use in safeguarding business practices easier. An early example is the company Priceline and its business method patent of allowing customers to name their own price which it received in August of 1998 (“Priceline.com Dismisses Patent Challenge,” 2002). Priceline has used patents focused on helping people travel cheaply and efficiently to help their business grow. Priceline owns booking.com, kayak.com which is a travel focused search engine, and OpenTable (Brachmann, 2015). A more recent example is the patent dispute between the Korean company Firstface and technology giants Apple and Samsung over the use of fingerprint biometric data used to open phones or other technologies. Firstface has three U.S. patents related to fingerprint authentication. “Firstface also have a variety of patents on face, fingerprint, and iris recognition technology in Korea, China, Europe, and Japan” (Klaus, 2022). Firstface filed a patent infringement case in the U.S. against Apple and won on two of the three claims which is why Apple is now more focused on face recognition for many of its products. Finally, an early and controversial patent decision allowed Amazon to patent its 1-click technology for shopping and purchasing items. They won an early patent dispute with Barnes and Noble over the use of the technology and then got a boost when Apple licensed the 1-click technology for its own use. However, Amazons patent expired in 2017 and now the controversy continues with debates over the validity of the patent under the ‘nonobvious’ test and its importance to Amazon as it launched its business away from only selling books.

You will submit the Case Analysis and Incident Impacts portion of the final project. The purpose of this assignment is to analyze the case and determine the impact of the incident. Prompt Analyze the ethical issues and determine the legal compliance issues within the organization, as well as the social and cultural impacts of these compliance issues. You will be expected to address the impact the incident may have had on the ethical and legal IT regulations at the time. The connection between the industry standards and the standards for informational technology should be determined, as well as the influence of the cultural impact on IT and cyber communication or commerce. Specifically the following critical elements must be addressed: Case Analysis Analyze the case to determine the ethical issues within the organization that may have led to the incident. What are these issues and why do you credit them for the incident? Determine legal compliance issues within the organization that may have led to the incident or could lead to future incidents. Were there any legal and ethical standards in existence at the time that were not followed by the organization? What were these issues and how did they impact the organization? Determine the societal and cultural impact of these compliance issues. Some things to consider in your assessment include specific targeting of demographic groups, victimization of certain customers, and so on. Incident Impact Determine the impact this incident may have had on the ethical and legal IT regulations of the time. If there were no direct results of this case, what may have been the indirect impact and/or what was the impact of similar cases? For example, what regulatory changes resulted from this or similar cases? What is your reasoning? Determine the connection between the industry standards and the standards in existence for information technology. Specifically, determine if the organization was lacking in either industry-specific or IT-specific alignment with regulations that may have contributed to the incident, and provide support for your conclusions. For example, misalignment with HIPAA laws in healthcare is an industry-specific deviation from standards. Cultural Impact: Analyze the influence this incident may have had on various cultural attitudes toward IT and cybercommunication or commerce. In other words, how could this incident impact views of information technology use ?
